These Terms of Service (“Terms”) govern your access to and use of the TenderBrew website at www.tenderbrew.bmes.site (the “Site”) and any products you purchase through it. The Site is operated by TenderBrew (“TenderBrew,” “we,” “us,” or “our”). By accessing or using the Site, or by placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase products or create an account. By using the Site you represent that you meet this requirement and that the information you provide is accurate and complete.

2. Your account

Some features may require an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Please notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

3. Products and availability

Kallucha is a non-alcoholic sparkling fermented coconut water. Product descriptions, ingredients, images, and packaging are provided for general information and may be updated as formulations, labels, or suppliers change. We work to display products accurately, but we do not warrant that descriptions, colors, or other content are error-free, and product images are illustrative. All products are offered subject to availability, and we may limit quantities, discontinue a product, or correct errors at any time.

4. Pricing

Prices are shown in U.S. dollars and are subject to change without notice. Unless stated otherwise, prices do not include taxes, shipping, or handling, which are calculated at checkout. Where a product is sold as a multi-pack (for example, a 12-can case), the listed price applies to the pack as described. If we discover a pricing error on an item you have ordered, we will contact you and give you the option to confirm the order at the correct price or cancel it.

5. Orders and acceptance

Your submission of an order is an offer to purchase. All orders are subject to our acceptance, and an order confirmation email acknowledges receipt of your order rather than acceptance of it. We may refuse or cancel any order — including after a confirmation has been sent — for reasons that include product unavailability, suspected fraud, errors in pricing or product information, or violations of these Terms.

6. Payment

You agree to provide current, complete, and accurate payment information and authorize us and our payment processors to charge your chosen payment method for the total order amount, including taxes and shipping. Payments are handled by third-party payment providers, and your use of their services may be subject to their own terms.

7. Shipping and delivery

Shipping options, costs, and estimated delivery times are shown at checkout. Title and risk of loss pass to you upon delivery to the carrier. Delivery estimates are not guaranteed, and we are not responsible for delays caused by carriers or events outside our reasonable control. You are responsible for providing an accurate shipping address.

8. Cancellations, returns, and refunds

Because Kallucha is a perishable food and beverage product, returns are limited. If your order arrives damaged, defective, or incorrect, please contact us within 7 days of delivery with your order number and a photo of the issue, and we will arrange a replacement or refund as appropriate. Approved refunds are issued to the original payment method. We may decline returns that do not meet these conditions.

9. Product information and health disclaimer

Kallucha is non-alcoholic and is pasteurized. It is a functional beverage intended to be enjoyed as part of a varied diet. Statements on the Site have not been evaluated by the Food and Drug Administration, and our products are not intended to diagnose, treat, cure, or prevent any disease. Information on the Site is provided for general educational purposes and is not medical advice. Consult a qualified healthcare professional before making changes to your diet, particularly if you are pregnant or nursing, have a medical condition, or have food allergies or sensitivities. Always read the product label for the most current ingredient and allergen information.

10. Email, promotions, and communications

By providing your email address — for example, to sign up for launch updates or a discount — you consent to receive related communications from us. You may unsubscribe at any time using the link in our emails. Promotional offers and discount codes may have eligibility rules, expiration dates, and other conditions, and may be modified or withdrawn at any time.

11. Intellectual property

The Site and its contents — including the TenderBrew and Kallucha names, logos, text, graphics, images, and design — are owned by TenderBrew or its licensors and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Site without our prior written permission, except as needed to view the Site for personal, non-commercial use.

12. Acceptable use

You agree not to use the Site to violate any law; infringe the rights of others; upload malicious code; attempt to gain unauthorized access to the Site or its systems; interfere with the Site’s operation; scrape or harvest data; or misrepresent your identity. We may investigate and take appropriate action against anyone who violates these Terms.

13. User submissions

If you submit reviews, comments, or other content, you grant TenderBrew a non-exclusive, royalty-free, worldwide license to use, display, and reproduce that content in connection with the Site and our business. You are responsible for the content you submit and represent that you have the rights to share it. We may remove any submission at our discretion.

The Site may link to third-party websites or rely on third-party services such as payment processors and shipping carriers. We do not control and are not responsible for the content, policies, or practices of third parties, and your dealings with them are solely between you and the third party.

15. Disclaimer of warranties

The Site and products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. 16. Limitation of liability

19. Governing law

These Terms are governed by the laws of the United States and the state in which TenderBrew is organized, without regard to conflict-of-law principles. Any dispute relating to these Terms or the Site will be subject to the exclusive jurisdiction of the courts located there, unless applicable law requires otherwise.

20. Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and TenderBrew regarding the Site.
